These Terms are the regulations (regulamin) for electronically supplied services within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
2. Our role and how tickets are issued
Your contract for the booking service is with Explorify Poland. We act as an intermediary between you and the Carrier; the contract of carriage itself is between each Passenger and the Carrier.
Ticket issuance. All reservations and Tickets are issued on our behalf by our affiliate Explorify LLC (USA), which holds the ticketing arrangements with Carriers and booking systems. Your booking confirmation, e-ticket receipt, payment requests and receipts may therefore show Explorify LLC as the issuing entity.
Payment. You pay Explorify Poland only, through the App or to our Polish bank account. You never need to make a separate payment to Explorify LLC.
Internal settlement. Explorify Poland and Explorify LLC settle the cost of issued Tickets between themselves in monthly intercompany transactions. This settlement is internal, is not charged to you, and does not change the price you agreed to pay.
Your rights are unaffected. Explorify Poland remains your point of contact and is responsible to you under these Terms and Polish law for the booking service, including complaints and refunds, regardless of which entity issued the Ticket.
Carrier's conditions. Each flight is subject to the Carrier's conditions of carriage and Fare Rules, which we show or link to before you pay. If they conflict with these Terms on matters of carriage, the Carrier's conditions apply.
Package travel. We sell flights only. If you buy other travel services from us for the same trip, we will tell you before payment whether package travel or linked travel arrangement protections under the Polish Act of 24 November 2017 on Package Travel apply.
3. Using the App and your account
We provide these electronic services free of charge: flight search, account registration, booking management, and notifications. Booking a Ticket is a paid service under section 4.
Requirements. A smartphone with [iOS 16 / Android 10] or later, an internet connection, an active email address, and push notifications enabled if you want flight alerts.
Eligibility. You must be at least 18 years old and legally able to enter contracts to make a Booking. You may book for minors and other Passengers if you are authorised to do so.
Account. Keep your login details confidential. You are responsible for activity on your account unless it results from our fault. Tell us immediately at [email protected] if you suspect misuse.
Prohibited use. You must not supply false data, make speculative or fraudulent Bookings, use bots or scraping tools, attempt to breach the App's security, or post unlawful content.
Ending the service. You may delete your account at any time in the App's settings or by emailing us; existing Bookings remain valid. We may suspend or close an account for serious or repeated breach of these Terms after notifying you with reasons, except where the law requires immediate action.
Risks. Using any internet service carries risks such as malware or interception of data. We apply the security measures described in our Privacy Policy.
Availability. We aim to keep the App available 24/7 but may interrupt it for maintenance or reasons beyond our control. We announce planned maintenance in advance where possible.
4. Searching, booking, prices and payment
Search results show fares supplied by Carriers and booking systems. Fares and seats are not reserved until a Booking is paid and confirmed, and may change or sell out while you search.
Total price. Before you pay, the App shows the total price in [PLN/EUR] including the fare, airline taxes and charges, our service fee and any optional extras you choose. We add no hidden charges. Extras bought later from the Carrier (bags, seats, meals) are paid to the Carrier under its own prices.
Placing a Booking. You select flights, enter each Passenger's details exactly as in their passport or ID, review the summary, accept these Terms and the Fare Rules, and press a button marked "Order with obligation to pay" or equivalent. The contract is concluded when we send our confirmation under section 5.
Payment methods: [card, BLIK, Przelewy24, bank transfer to Explorify Poland's account]. Card and online payments are handled by [payment provider name]; we do not store full card numbers.
Bank transfer. If you pay by transfer, the fare is held only until the deadline in the payment request. If funds are not received in time, the reservation may be cancelled automatically and the fare can no longer be guaranteed.
Price changes before issuance. If a Carrier withdraws or reprices a fare before the Ticket is issued, we will contact you. You may accept the new price or cancel and receive a full refund of everything you paid within 14 days.
Invoices. We issue a receipt or invoice for each Booking. Business customers must provide company name and tax ID before payment.
5. Confirmation and ticket issuance
Tickets are issued within 72 hours of your payment being received, usually much sooner.
After payment we send a booking confirmation to your email and in the App, with your booking reference (PNR) and itinerary.
Once Explorify LLC issues the Ticket, you receive the e-ticket receipt with the ticket number(s). Your Booking is only guaranteed once ticket numbers are issued.
If a Ticket cannot be issued at the confirmed price within 72 hours for reasons outside your control, we offer an alternative or refund everything you paid within 14 days, at your choice.
Check your confirmation and e-ticket immediately. Report any error in names, dates or routes within 24 hours to [email protected]; many Carriers allow free corrections only in that window.
Keep your booking reference. Most Carriers also let you manage the Booking, check in and choose seats on their own website using it.
6. Changes, cancellations and refunds
What you can change or get back depends on the Fare Rules of the Ticket you bought; many economy fares are non-refundable.
Requests. Send change or cancellation requests through the App or to [email protected], quoting your booking reference. We process them with the Carrier through Explorify LLC.
Costs. You pay any Carrier change fee, any fare difference, and our handling fee of [amount] per Passenger per change, shown before you confirm.
Refundable fares. We refund the amount the Carrier returns, less any Carrier cancellation penalty and our handling fee of [amount]. Our original service fee is non-refundable once the Ticket has been issued, because the service has been fully performed.
Non-refundable fares. If you do not travel, you can still request a refund of government taxes and airport charges that depend on actual travel. We pass on what the Carrier returns, less a handling fee of [amount] that will never exceed the refund.
No-show. If you miss a flight, the Carrier may cancel all later segments of the same Ticket, including the return. Contact us before departure if your plans change.
Timing and method. We pay refunds within 14 days of receiving the funds from the Carrier, to the original payment method or to the bank account you confirm. Carriers may take several weeks to release refunds. For bank transfers we may first send a small verification transfer to confirm your account.
Carrier vouchers. If a Carrier offers a voucher instead of money, you may refuse it where you are legally entitled to a cash refund (section 9).
7. Right of withdrawal
There is no 14-day right to withdraw from a flight Booking. Under the Polish Consumer Rights Act of 30 May 2014, which implements EU Directive 2011/83/EU, the statutory right of withdrawal for distance contracts does not apply to passenger transport services booked for a specific date.
You may still cancel under section 6 and the Fare Rules.
Free account services (registration, alerts) can be ended at any time by deleting your account.
[Optional — decide before publishing] Bookings cancelled within 24 hours of payment and at least 7 days before departure are refunded in full, except where the Carrier's Fare Rules prevent it. Flights to or from the USA follow the US Department of Transportation 24-hour rule where the Carrier applies it.
8. Passenger responsibilities
Each Passenger is responsible for being able to travel on the booked flights.
Names and data. Enter names exactly as in the travel document. Carriers may refuse boarding or charge for name corrections, and many do not allow name changes at all.
Travel documents. Hold a valid passport or ID, visas, transit visas and electronic authorisations (for example ESTA, ETA, or the EU's ETIAS once it applies) for every country on the route. We give general information only; check official government sources before travel.
Health and entry rules. Meet any vaccination, health or customs requirements of the destination.
Check-in and boarding. Check in online or at the airport within the Carrier's deadlines and arrive at the gate on time.
Baggage. Baggage allowance, fees and restrictions on dangerous goods are set by the Carrier and shown in the Fare Rules.
Special assistance. Tell us at booking or at least 48 hours before departure about reduced mobility, medical equipment, pregnancy, unaccompanied minors or pets, so we can request them from the Carrier.
Contact details. Keep your phone number and email correct. We use them to tell you about schedule changes; we are not responsible for missed notices caused by incorrect details.
If boarding is refused because of missing documents or a Passenger's conduct, the Carrier's rules apply and no refund is due from us.
9. Flight disruptions and air passenger rights
When a Carrier cancels, delays or reschedules a flight, the Carrier is responsible for your passenger rights. We help you exercise them.
EU rights. For flights departing from the EU/EEA, or arriving there on an EU carrier, Regulation (EC) No 261/2004 may entitle you to care, re-routing or a refund, and compensation of EUR 250–600 depending on distance, unless extraordinary circumstances apply. Other countries have their own rules, such as UK261.
Our assistance. When we learn of a schedule change, we notify you by email, push notification or WhatsApp and offer the options available from the Carrier: accept the change, rebook, or cancel for a refund.
Refunds after cancellation. If the Carrier cancels and you choose a refund, we pass on the full amount the Carrier returns for the Ticket, including our service fee for the cancelled flights, within 14 days of receipt.
Compensation claims are made against the Carrier. You may submit them yourself free of charge; we can help prepare the claim. If the Carrier does not respond, you may contact the Civil Aviation Authority (Urząd Lotnictwa Cywilnego, www.ulc.gov.pl) or the national enforcement body of the departure country.
Self-transfer. If you combine separate Tickets yourself or we sell a self-transfer itinerary (clearly labelled in the App), a delay on one Ticket does not protect your connection on another.
10. Liability
We are liable for properly performing the booking service. The Carrier is liable for the flight itself.
We are not liable for the Carrier's performance of carriage, including delays, cancellations, lost baggage, injury or denied boarding; these are governed by the Carrier's conditions, Regulation 261/2004 and the Montreal Convention.
We are not liable for losses caused by incorrect data you provided, missing travel documents, or events beyond our reasonable control such as strikes, airspace closures or system failures of Carriers or booking systems.
Toward business customers, our total liability per Booking is limited to the amount paid for that Booking and excludes lost profits.
Nothing in these Terms limits liability that cannot be limited by law, including for intentional damage, or limits any statutory right of a Consumer.
11. Complaints and dispute resolution
We answer every complaint within 14 days of receipt, by email or in the App.
Send complaints to [email protected] or in writing to Explorify Poland's address above, with your name, booking reference, a description of the problem and what you request.
Complaints about the flight itself (delay, baggage, service on board) should go to the Carrier; we will forward them on request.
Consumers may use out-of-court dispute resolution, for example through the Provincial Inspectorate of Trade Inspection (WIIH), a municipal or district consumer ombudsman (rzecznik konsumentów), or the bodies listed by UOKiK at www.uokik.gov.pl. Consumers from other EU countries can get free help from the European Consumer Centre network.
Using these routes is voluntary and does not prevent you from going to court.
12. Final provisions
Governing law. These Terms are governed by Polish law. A Consumer living in another EU country keeps the protection of the mandatory laws of that country.
Courts. Disputes go to the competent common courts. For business customers, the court competent for our registered office in Warsaw.
Sole traders. Natural persons running a business who book for purposes not of a professional nature for them enjoy the consumer protections set out in Polish law (Civil Code, art. 385⁵).
Language. These Terms are available in Polish and English. If the versions differ, the Polish version prevails for Consumers in Poland.
Changes. We may change these Terms for legal, technical or business reasons. We notify registered users at least 14 days before changes take effect; Bookings already made stay under the Terms in force when they were made. If you disagree, you may delete your account before the change.
Accessibility. Our accessibility statement for the App is available at [link], in line with the European Accessibility Act requirements for passenger transport booking services.
Privacy. We process personal data as described in our Privacy Policy.
Access to Terms. These Terms are available free of charge in the App and at www.byexplorify.com, in a form you can download, store and print.
